Terms of Service

Effective Date: June 24, 2026

Welcome to Some Random Old Dude (SRODUDE.com). By submitting a Custom Song Order Form (the "Services"), you (the "User" or "Client") agree to be bound by the following Terms of Service. Please read them carefully before submitting your order.

1. Governing Law

This Agreement and all performance hereunder shall be governed by, interpreted, and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law principles. Any legal action arising from this agreement must be brought in a court of competent jurisdiction within the State of Missouri.

2. Intellectual Property & Copyright Ownership

Standard Ownership: Unless explicitly modified by Section 5 (Copyright Buyout Option) of this agreement, the creator ("Some Random Old Dude" or "SROD") retains 100% of the sole and exclusive copyright, title, and interest in and to all music, melodies, arrangements, and lyrics generated for the custom song.
Limited User License: Upon delivery and full payment, the User is granted a non-exclusive, perpetual, personal-use license to download, play, and share the song with friends, family, and the individual(s) the song is about.
No Commercial Distribution: The User may not upload the song to streaming platforms (including but not limited to Spotify, Apple Music, or YouTube Music), distribute it for profit, or use it for commercial broadcasting unless explicit, written authorization is granted by SROD.

3. Promotional Rights Granted by User

By submitting the "Inside Story" details, names, and profile information, the User explicitly grants SROD a worldwide, royalty-free, non-exclusive license to use the custom lyrics, themes, and final recorded song in promotional materials. This includes, but is not limited to, social media posts (Facebook, Instagram, YouTube, TikTok), portfolio displays, and website features on SRODUDE.com.

4. Distribution Restrictions

SROD agrees not to commercially release, distribute, or put the custom song up for sale/streaming on global distribution catalogs (e.g., Bandcamp, Spotify) without the explicit, written permission of the User, unless the song is repurposed in a way that removes the User’s specific personal identifiers.

5. Copyright Buyout Option & Additional Fee

If the User wishes to acquire full copyright ownership of both the lyrics and the music (transferring all intellectual property rights from SROD to the User), the following terms apply strictly:

The Fee: An additional buyout fee of $15.00 USD must be paid to SROD.
The Deadline: Payment for the copyright buyout must be completed within twenty-four (24) hours from the exact moment the completed song is delivered to the User.
Timestamp Enforcement: Timing is strictly enforced based on the official outbound email timestamp sent from the domain srodude.com. If the buyout fee is not successfully processed within this 24-hour window, the copyright automatically remains with SROD under the terms outlined in Section 2.

6. Content Discretion

SROD reserves the right to reject any custom song request that contains explicit hate speech, defamatory material, or content deemed inherently malicious or illegal under state and federal law. In the event an order is rejected by the studio, any fees paid for that specific project will be fully refunded.
